Monthly Program: The New ADAAG - The 2010 Standard for Compliance with the ADA

It has been almost 20 years since the enactment of the Americans with Disabilities Act (ADA). There have been little changes to the guidelines, but many interpretations have been offered by the Department of Justice (DOJ), who enforce the Federal Law. The new guidelines or "2010 ADA Standards" as they're known, contain significant changes in addition to providing additional direction for compliance. These standards will be optional starting March 15, 2011 and mandatory on March 15, 2012. Kerwin Lee, AIA will give an overview of the changes and how that will affect the design and built community.

Join us after the program in the AIA East Bay Chapter Office for a wine and cheese networking reception.

Building Under the California Green Building Code

Designing and building under Part 11 of the Title 24, the California Green Building Standards is a small portion of going Green. *Compliance with Part 11 does not eliminate or alleviate compliance with the other parts of the building regulations.* Opening up a building for light and ventilation may require applying the atrium provisions of the code. Other required fire separations will need to be addressed to provide safety for the occupants and building.

This program will look at how green design can create challenges for compliance with other portions of the code related to fire and life safety.

Breaking News regarding the New California Energy Standards

From John Britton, AIA:

"The effective date for the 2008 Building Energy Efficiency Standards (Title 24, Parts 1 and 6) has been changed to January 1, 2010.

The California Energy Commission adopted the 2008 Standards on April 23, 2008, and the Building Standards Commission approved them on September 11, 2008. The Standards were scheduled to become effective on August 1, 2009.

The Energy Commission has experienced delays in completing the public domain compliance software. The Energy Commission had anticipated that these software programs would be available earlier, however the software required further programming attention before the programs could be released. The Energy Commission is resolving those problems, and will provide the programs in the near future.

This delay provides the industry and building officials more time to prepare for the new Standards. The Energy Commission will use this additional time to provide more information for the Standards and work with the California utilities, building industry and the California Building Officials to provide training on the new Standards."

About the Access Specialist Program

Join us for a round table discussion on the new State Certified Access Specialist Program (CASP) and its impact on the review and enforcement of accessibility regulations. We will explore how they relate to architects and to the disabled community. Peter Margen will join the forum to share his expertise in the area of disability policy, universal design and the Americans with Disabilities Act (ADA).

The Certified Access Specialist Program (CASP) was approved by the Division of the State Architect (DSA) and began accepting applications in July of 2008. The certificate serves as evidence that you met the State Architects specific criteria to be identified as a Certified Access Specialist.

In recent years numerous civil claims have been filed against public business and property owners for accessibility issues, many of which are settled out of court. SB 1608 contains language that will change the way construction related accessibility claims are handled throughout the litigation process.

Senate Bill 1608 was introduced to amend sections of the B&P, Government, Health & Safety and Civil Codes relating to disability access. The bill would require that beginning on July 1, 2009, all inspections of a place of Accommodation (AHJ) that relate to permitting, plan checks or new construction be conducted by an inspector who is a certified access specialist. This means local building departments will be required to employ or retain at least one CASP. It also means that the expected number of applicants could double, together with increased opportunities for ACIA inspector members.

Although building inspectors have historically enforced ADA compliance CASP is the first certification of its kind that is dedicated to accessibility code and ADA enforcement. The first applications are now being accepted for the CASP examinations and the first list of Certified Access Specialist will be posted by October 31st. Individuals holding CASP certification will be required to re-certify every three years.

Monthly Program: Steven R Winkel, FAIA Introduces the New California Green Building Code

California has just adopted the Nation's first state-wide green building standards code. This new code puts California in the forefront of promoting green building technologies along with promoting increased energy and water conservation in our built environment The new code becomes a part of the building codes for the State and as such will be updated every three years to take advantage of lessons learned in implementing these new standards and to allow California designers and builders to take advantage of ongoing improvements in green building techniques and technologies.

The code will be voluntary for the next three years as it is tested throughout the State. It will be used in concert with locally adopted green regulations which are still allowed to be developed to accompany the statewide green code. It will become effective as a voluntary standard in January 2009 and it is expected to be a mandatory part of the 2011 California Building Code.

AIA East Bay chapter member, Steven R Winkel, FAIA, the architect member of the California Building Standards Commission, the body which adopts building codes in California, will explain the development and implementation of the new green code.

Designing Skylighted Buildings

From the Pacific Energy Center:

The 2005 California Title 24 Energy Standards for Nonresidential Buildings include a prescriptive requirement for skylights and electric lighting controls in spaces greater than 25,000 sq. ft. where the ceiling is above 15 ft. in height and lighting power density is 0.5 watts/sq.ft. or greater.

Draft changes to the 2008 California Title 24 Energy Standards for Nonresidential Buildings, scheduled to take effect in April of 2009, reduce the threshold to spaces greater than 8,000 sq. ft. This will broaden the requirement to many building types not previously covered such as gymnasia and moderate-sized retail stores. Are you ready? Space is still available in two Pacific Energy Center programs providing guidance and free software tools to assist in the design of skylighted buildings that reduce energy use while providing high-quality interior lighting environments.

These programs are free of charge, but pre-registration is required since space is limited. For registration and more detailed information about this program, go to
www.pge.com/pec/classes on the Internet and click on the "SHOW CLASSES" button. You may also register by phone at 415-973-2277.

These classes are funded by California utility customers and administered by Pacific Gas and Electric Company under the auspices of the California Public Utilities Commission.

Brown Bag: Code Compliance Sheets

BROWN BAG LUNCHEON ON
CODE COMPLIANCE SHEETS
Noon to 1:30PM, Thursday, January 31st

AIA East Bay, 1405 Clay Street, Oakland

The Codes Committee invites you to a Brown Bag Luncheon (BYOL) to share your office’s Code Compliance Sheets – and to propose new ones. Please don’t be shy! Trim off your title block if you wish. It is our intent to look at different approaches to demonstrating to reviewing officials what steps we have taken to assure that our projects meet the requirements of structural, access and fire and life safety codes.

Do you have any template sheets, forms or checklists that you use to assist you in determining and demonstrating your allowable building areas and heights, occupancy classifications, construction type, height and setbacks? How about exit widths and maximum travel distances? Accessible parking counts and paths of travel? And others.

What do you submit to the State (DSA) that is different than other AHJ’s (Agencies Having Jurisdiction – i.e. cites, counties, joint powers boards, etc.)?

How do you show AMMR’s (Alternate Materials and Methods Requests)? How about Deferred Approval (design/build) items? Local fire department approvals for fire hydrants and fire equipment access?

It is the intent of the Committee to eventually put together a set of guidelines, or a list of references to such guidelines, that we can place on the website to assist our members in preparing thorough and accurate code reviews, as well as preparing the documents that demonstrate to our plan reviewers what steps we have taken to assure that our projects meet the code.

Also, some of the codes in the UBC and CBC are the same, but located in different sections. This seminar covers this information as well. In an effort to further aid users, an explanation as to why the codes differ is provided.

2007 CBC Residential Provisions - Friday December 7

This course has been developed in response to a decision by the State of California not to adopt the 2006 International Residential Code (IRC). This class is designed to provide an overview of 2006 IBC requirements for residential occupancies as well as California amendments intended to better align the 2007 CBC with certain concepts in the IRC.. The seminar discusses basic code concepts, proper use of code tables and proper construction of dwelling units.
